Virginia Workers’ Compensation accident necessitates neck fusion surgery due to slip on ice.

J. Vaughn, a cable installer, injured his neck slipping on ice. The insurer agreed to pay Vaughn workers’ compensation. However, the insurer refused to pay for his neck surgery. The insurer argued the surgery was due to a pre-existing condition. The insurer then cut off compensation and medical care. We won an award for Vaughn before the Deputy Commissioner at the Virginia Workers’ Compensation Commission. The insurer appealed the Deputy decision to the Full Commission. On August 15, 2016 the Commission awarded Vaughn $55,000.00 in back benefits, an ongoing weekly award of $855.00 per week, and his requested fusion surgery. In ruling for Vaughn, the Full Commission cited the opinion from Vaughn’s treating doctor which said Vaughn’s slip on ice had aggravated his spinal stenosis.
